- "API": The ChinookAPI cloud-based RAM optimization API.
- "User": Any person or entity that registers and uses ChinookAPI.
- "Service": The API, documentation, website, and related tools.
- "Subscription": A pricing plan for API access.
- "API Key": A unique identifier that grants access to ChinookAPI.
3. Account Registration & API Access
3.1 User Eligibility
To use ChinookAPI, you must:
- ✓Be at least 18 years old or have legal guardian consent.
- ✓Provide accurate registration information (email, company details).
- ✓Comply with applicable laws (including GDPR, export regulations).
3.2 API Key Management
- API keys must be kept confidential.
- You are responsible for all API calls made using your key.
- If your key is compromised, you must notify us immediately at hello@chinookapi.com.
🚨We reserve the right to revoke API keys if abuse, fraud, or misuse is detected.
4. Service Availability & Modifications
- ChinookAPI does not guarantee 100% uptime but aims for 99.9% availability.
- We may update, modify, or discontinue features without prior notice.
- We may suspend service for maintenance, security updates, or compliance reasons.
🚨We are NOT liable for service interruptions due to:
- ✓Scheduled maintenance or unexpected outages.
- ✓Third-party failures (e.g., cloud providers, payment processors).
- ✓Security breaches, cyberattacks, or force majeure events.
5. Billing, Payments & Refunds
5.1 Subscription Plans & Pay-As-You-Go
ChinookAPI offers the following pricing models:
- 💰Pay-as-you-go: Charged based on actual API usage.
- 💰Subscription plans: Fixed monthly fees for a set quota.
5.2 Payment Processing & Security
- Payments are processed via Stripe or PayPal.
- ChinookAPI does NOT store credit card details.
- Billing is automated, and overdue invoices may result in API suspension.
5.3 Refund Policy
🚨All payments are final and non-refundable. The only exceptions:
- ✓If ChinookAPI fails to deliver API access for more than 7 consecutive days.
- ✓If an unauthorized charge is reported within 14 days.
6. User Responsibilities & Acceptable Use
You agree not to:
- ❌Share or resell API keys with third parties.
- ❌Exploit or overload the API (e.g., automated scraping, DDoS attacks).
- ❌Use ChinookAPI for illegal purposes (e.g., hacking, fraud).
- ❌Reverse-engineer or attempt to copy the API infrastructure.
🚨Violating these rules may result in:
- Immediate termination of your account.
- Legal action for damages.
7. Data Privacy & Compliance
- We collect only necessary user data (see Privacy Policy).
- API logs may be stored for security & billing purposes.
- Users can request data deletion via hello@chinookapi.com.
- ChinookAPI complies with GDPR and Dutch privacy laws.
🚨You are responsible for ensuring your use of the API complies with local laws (e.g., GDPR, CCPA).
8. Intellectual Property & API Ownership
- ChinookAPI owns all intellectual property related to its API services.
- You may not claim ownership over API data, models, or algorithms.
- You may not use our trademarks (logo, branding) without written permission.
9. Termination & Account Suspension
We may suspend or terminate access if:
- A user fails to pay outstanding invoices.
- Abuse, fraud, or illegal activity is detected.
- API usage violates these Terms.
🔹Users may cancel their accounts at any time via the dashboard.
🚨No refunds are given for early termination unless otherwise stated in Section 5.
10. Limitations of Liability (NO WARRANTIES)
🚨CHINOOKAPI IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES.
We are NOT liable for:
- ❌Indirect, incidental, or consequential damages.
- ❌Service failures due to cloud provider issues (AWS, DigitalOcean, etc.).
- ❌Data loss or API response failures.
💰Maximum Liability: Our total liability is limited to the amount you paid in the last 3 months.
11. Governing Law & Dispute Resolution
These Terms are governed by Dutch law. Any disputes shall be resolved in the courts of Amsterdam, Netherlands.
🚨Alternative Dispute Resolution (ADR): Users agree to attempt mediation before taking legal action.
12. Changes to These Terms
We may update these Terms at any time. Continued use of ChinookAPI after changes means you accept the new Terms.
